To the Honorable Kenneth A. Bain, Judge of the said Court:
Your complainant, Ruth Rebecca Cassell, humbly complaining would respectfully show unto your honor that:
She resides in the City of Portsmouth, Virginia, and has been domiciled in, and an actual bona fide resident of this State for more than one year preceding the institution of this suit.
On the 28th day of September, 1912, in the City of Portsmouth, your complainant was married to one John Edwin Wadsworth Cassell, as will appear on the certificate of marriage herewith filed and marked "Exhibit A," and made a part of this bill.
Since the time of marriage your complainant has lived with her said husband continuously until some time the first part of September, 1924 when they separated and have not since lived together.
Your complaint's husband has been negligent and excessively intemperate in drinking ardent spirits and insufferably abusive and violent to her, and has never provided for the necessities of life for your complainant. Your complainant's husband, the said John Edwin Wadsworth Cassell has not only treated her with cruelty, but has broken his marriage vows and has committed adultery with one Bertha Bennitt, within the past few months, and with others, the names of whom are unknown to your complainant. Indeed he is reckless in his habits and as your complaintant has been informed and believes that he is a habitual frequenter of bawdy houses in the City of Portsmouth and the County of Norfolk, and has been seen respeatedly with various women in the City of Portmsouth and County of Norfolk, whose reputations are bad for chastity; and he is so open and indifferent about his said acts that they became and were commonly, generally and notoriously known throughout the City of Portsmouth.
That your complainant has not voluntarily cohabited with her said husband, John Edwin Wadsworth Cassell, since her knowledge of the acts of adultery.
Your complainant further avers that due to her husband's conduct and cruel treatment it has been necessary for her to leave her home to seek shelter with her sister, with whom she is now living.
Your complainant avers that she is without means of support except that given her by friends or that which she earns. Your complainant further represents that her said husband is the owner of the following property: Three lots in Naval Place, Key Road, City of Portsmouth, the value of two thousand dollars ($2,000.00); half owner of house and lot, # 2802 Green Street, Portsmouth, the value of fifteen hundred dollars ($1,500.00); Nash seven-passenger Sedan, license no. 67167, the value of one thousand dollars ($1,000.00) and now has approximately five hundred dollars ($500.00) in cash in the Merchants and Farmers Bank; household and kitchen furniture including: player piano, bed room suite, sewing machine, kitchen cabinet, refrigerator, range, two tables, and large heater, of the value of five hundred dollars ($500.00). Your complainant further represents that the said defendant has threatened and your complainant fears that he will carry his threat into execution, to sell and dispose of his said property before mentioned and described, to prevent your complainant from obtaining alimony therefrom for the support of herself; and that the said defendant ought to be restrained by an injunction of this court from selling, assigning, encumbering or otherwise disposing of the above described property until the hearing of this cause and until suitable provisions are made for the support of your compainant.
Wherefore, inasmuch as your complainant is remediless in the premises save in a court of equity, and to this end she prays that the said John Edwin Wadsworth Cassell be made a party defendant to this bill and be required to answer the same, but an answer under oath here being expressly waived; and that your complainant may be granted a divorce and be forever free from the bonds of matrimony existing between her and the said defendant; that this court will decree such portions of the property of the said defendant or such sums of money to be paid by the defendant to your complainant as this court may deem necessary and proper for the maintenance of your complainant; and that the said defendant my be required to pay your complainant a sufficient sum of money to enable her to employ counsel to prosecute this suit and for the support of your complainant during the pendency of this suit; and that the said defendant may be restrainted by the injunction of this court from selling, assigning, encumbering or otherwise disposing of the above described property hereinbefore mentioned and described, until the further order of this court; and that is may please the court to grant unto your complainant to writ of injunction to be directed to the said John Edwin Wadsworth Cassell restraining him from selling, assigning or otherwise disposing of the property hereinbefore mentioned and described, until the further order of this court; and that your complainant may have such further, other and general relief in the premises as equity may require and to this honorable court shall seem meet and proper. And your complainant will ever pray, etc.

This cause came on this day to be heard (in which service of process has been personally had upon the defendant who has failed to appear, defend, plead or answer on the bill of complaint filed and exhibited herein, and depositions of witnesses taken in support thereof, and was argued by counsel.
On consideration whereof it appearing to the court that the complainant is entitled to the relief prayed for in her said bill, it appearing from the depositions of witnesses that the said defendant comiited adultery within the part five years and that it was not committed by the procurement or connivance of the said complainant and that the said parties have not volunarily cohabited together since the knowledge of the said acts of adultery, and that the said complainant has been domiciled in and has been an actual bona fide resident of the City of Portsmouth, State of Virginia, for at least one year preceding the commencement of this suit, and that said parties last cohabited as man and wife, in said city of Portsmouth.
It is, therefore, adjudged, ordered and decreed that the said complainant, Ruth Rebecca Cassell, and the said defendant, John Edwin Wadsworth Cassell, be divorced from each other from the bonds of matrimony, and the marriage heretofore celebrated is hereby dissolved; and that all property now owned or hereafter acquired by the said complainant shall be held by her free from all marital claims of her said husband, John Edwin Wadsworth Cassell; and that all property now owned or hereafter acquired by the said defendant, John Edwin Wadsworth Cassell, shall be held by him free from all marital claims of his said wife, Ruth Rebecca Cassell, except the cost of this proceeding hereafter mentioned. The court doth further adjudge order and decree that the said John Edwin Wadsworth Cassell shall pay unto the said Ruth Rebecca Cassell her costs by her in this behalf expended, and to T. E. Gilman, the complainant's attorney, the sum of one hundred dollars ($100.00)
The said parties to this cause shall not be permitted to remarry until six months shall elapsed from the date of the entering of this decree.
Nothing further remaining to be done in this cause, it is ordered that same be removed from the docket.

Mrs. Caroline K. Manning---Following closely the death of her husband, James E. Manning of this city, who passed away at 6:30 o'clock last Monday morning, Mrs. Caroline Knock Manning died at 8 o'clock Monday night, in the residence of her parents in Assawoman, Va., where she and her husband and their children were visiting. Mrs. Manning, like her husband, was a victim of pneumonia.
She had not been told, at the time of her death, of the demise of her husband.
Two children, James E. Manning, Jr. and Ruth Manning, survive her.
The funeral service and burial of Mrs. Manning will take place this afternoon in Assawoman.
Mr. Manning was a member of the firm of W. C. Gleason, Jr. and company, druggists, operating a pharmacy in Scottsville, and another in Port Norfolk. The latter was recently acquired from L. M. Bailey.
The deceased was what might be termed a self-made man, having been practically the head of a family since he was 13 years old, when his father died. He worked hard, and contributed largely to the support of his mother and brothers since that time. He was a young man of most engaging personality, which attracted and held friends to him. His death came at a time when he had after an early business struggle, practically gotten himself on a well established

Last Will and Testament of Carrie E. Manning
I, Carrie E. Manning of the City of Portsmouth, Va. being of sound mind and memory, do make publish and declare this as my last will and testament.
I direct that my brother, William M. Land, be appointed as my executor and request the Court to allow him to qualify without surety, and that no appraisement be made of my estate.
I direct my said executor to dispose of all my personal property to the best of his judgement, and further direct him to sell all my real estate at public auction so soon after my death as is practical and dispose of the proceeds from both personal and real estate as follows,
First: pay all my just debts
Second: pay one sixth of the amount lest after the payment of my debts, to Hebert E. Manning, one sixth to Jno. C. Manning, one sixth to Wm. A. Manning, one sixth to Kenneth G. Manning, my children, one sixth to Jas. E. Manning and Ruth Manning children of my deceased son, Jas. E. Manning, and one sixth to Elizabeth M. Taylor, child of my deceased child Fannie M. Taylor, but deduct from the amount of Wm. A. Manning the amount he owes me as Guaridan of Elizabeth M. Taylor, as evidenced by a note from him to me as such Guardian.
In witness whereof I have hereunto subscribed my name this 30th day of July 1920.

Land for obtaining a probat of the said will in due form.

Mrs. Carrie E. Manning, widow of John C. Manning, died at 11:03 o'clock Saturday night in the residence, 7 Cooke Street, Park View, at the age of 53 years. Mrs. Manning had been ill for the last fifteen months.
She is survived by fours sons, J. C., R. E. and W. A. Manning of this city, and K. G. Manning, attached to the U. S.S. Mississippi. Two brothers, E. B. Land of Newport News and Captain William M. Land of the city Police Department, also survive her.
The funeral service will be conducted in the residence at 4 o'clock tomorrow afternoon. Burial will take place in Oak Grove Cemetery.

Manning--In the residence, 7 Cooke Street, Park View, Portsmouth, Va, on Saturday, March 19, 1921 at 11:03 o'clock p.m. Mrs. Carrie E. Manning, widow of John C. Manning, age 53 years.
The funeral service will be conducted in the residence at 4 o'clock Tuesday afternoon. Friends and acquaintances are invited to attend. Interment in Oak Grove Cemetery.

Mrs. Carrie E. Manning---the funeral service of Mrs. Carrie E. Manning, widow of John C. Manning, who died last Saturday night in the residence, 7 Cooke Street, Park View, took place there at 4 o'clock yesterday afternoon. Rev. J. J. Bradford, pastor of the Central Methodist Church, conducted the service, and was assisted by Rev. W. E. Abernathy, former pastor of that church.
Burial took place in Oak Grove Cemetery. The pallbearers were as follows: Dr. F. S. Hope, F. T. Briggs, George Owens, T. C. Riddick, James Rea, William Redd, Lennie Moore, and a. M. Sykes.
There were many foral tokens of respect and esteem. During the service, Wray Morse, sang a selection.
