7. Chancery suit 2201, Robert Hodges vs devises of Richard Hodges, exec of Thomas Hodges, 1769 in Norfolk Co., Virginia
To the Worshipful the Justices of the County of Norfolk sitting in Chancery
Humbly complaining sheweth your orator Robert Hodges that the late Richard Hodges was left executor of the last will and testament of Thomas Hodges deceased and did on the eighteenth day of September the year of our Lord one thousand seven hundred and sixty six obtain administration thereon for which administration your orator became security as appears by the bond on record in this worshipful Court and that the said Richard was by verdict of a jury in this Court found to have misapplied said estate and a loss to accrue to the children of said Thomas to the amount of twenty five pounds nineteen shillings and nine pence which was paid by your orator as security for the said administration was appears by the judgements and executions among the records of this court and further your sheweth that the costs and other unavoidable expenses incurred by reason of the said Richard's undue administration of said estate and which expenses were paid and sustained by your orator do amount to the sum of thirty eight pounds three shillings and four pence that your orator has an amount as yet unsatisfied of seventeen pounds seven shillings and eleven pence which your orator does present to the said Richard as executor to the said Thomas and which he accordingly received but did never discharge and that your orator has a simple contract account against the said Richard Hodges amounting to three pounds five shillings and eleven pence all which several accounts are referred to in the general state to this bill annexed and your orator humbly prays that said state and accounts be taken as part of this his bill and your orator is informed that there remains no personal estate beloning to said Richard Hodges and that by his will bearing date the thirtieth day of July in the year of our Lord one thousand and seven hundred and sixty six he did devise to his sons Richard Hodges, Randolph Hodges, William Hodges, grandson William Hodges, an infant under the age of twenty one years, and his daughter Elizabeth Smith all his real estate in fee simple but neglected to make any provision for securing your orator as in all equity though and your orator will hope that the said devisees and Thomas Smith the husband of said Elizabeth will knowing the truth of the promsies would have before this (plob of ink) in an amicably manner reimbursted your orator out of the said lands to them devised in all equity they ought to do and as they have been often in a friendly manner requested.
But now so it is may it please your worships that the said Richard, Randolph, Willis, William, Thomas and Elizabeth confirming and considering with same persons to your orator known whosonames when this covered he prays may be made parties to this bill with apt words do charge them, have absolutely refused to reimburse or in any wise satisfy your orator (/) the premises but the said devised lands and real estate do keep and occupy without paying unto your orator the said sums which by reason the said divisors malcious and your orator was obliged to pay and expend all which is contrary to equity and good conscience In tender consideration whereof and to the sons that the said lands by the said will divised (to which will prays leave to refer and (plob of ink) the same may be taken as part of this bill) may be charged in the hands of said devisees with the payment of the said sums of money be your orator paid and expended as well as their expenses accuring thereon and the said account which your orator had produced against the estate of said Thomas Hodges and that the forementioned considerates may be compelled of all true and perfect answers to make upon their respectable & corporal oaths to all and singular the premises and allegations in this bill as fully and particularly as if the same were herein again interrogated and propounded now especially whether the said Richard did have any personal estate and how the same was administered & whether they do not occupy under the said will the several tracks of land thereby devised & whether your orator did not pa the said sums by reason of said security and whether any satisfaction has ever been made to your orator out of the estate of said Richard the devisor or by the considerates or any of them or any person on their behalf and that such other order and decree may be made touching the premises as to your whorships in your great wisdom that summit and agreeable to equity and good conscience may it please your worships to grant unto your orator his majesty's gracious writ of subpona etc. and your orator shall pray etc
