Pursuant to the annexed decree of the worshipful Court of Norfolk County the subscribers three of the Commissioners therein named have made partition of the lands and slaves belonging to the Estate of Mathias Hodges dec'd in the following manner:
To the heirs of Joseph Hodges dec'd the land designated in the plat hereto annexed No. 1 58 1/2 acres and negro Jacob and they are to receive of the Executor of Mathias Hodges dec'd nenety two dollars and 55 cents.
To William Hodges, Lot No. 2. 75 acres and negro Isaac he paying to the Executor as aforesaid seventy eight dollars and 45 cents.
To John Hodges, the land No. 3. 60 acres with all the buildings thereon he paying as aforesaid seven hundred and eighty nine dollars and 45 cents
To Matthias Hodges lot no. 4. 28 1/2 acres and negro Silvia also the newest or last built house now standing on lot no. 5 and to receive of the executor two hundred and sixty dollars & 55 cents
To Nathaniel Hodges lot no. 5. 33 acres with the buildings thereon (except the last built house which is attached to lot no. 4 as before stated) and negro Clarissa and he is to receive of the executor ten dollars & fifty five cents.
To Abigail Hodges the land no. 6. 31 acres and negro Daniel and he is to receive of the executor sixty two dollars & 55 cents
To Zachariah Hodges lot no. 7. 22 acres and negroes Jim & Betty and he is to receive of the executor one hundred and fifty two dollars & 55 cents
To Sally Hodges lot no. 8. 31 acres and negro Lucy and she is to receive of the executor two hundred and thirty one dollars & 55 cents.
To James Hodges lot. no. 9. 60 acres with the buildings thereon & negro Charlotte & he being the executor is to pay out of his now funds one hundred & nine dollars & 45 cents.
To Christopher Hodges a house & lot at the south east intersection of High & Washington streets in the Town of Portsmouth & negro Fanny and he is to receive of the executor one hundred & ten dollars and 55 cents.
And to Jessee Hodges a piece of land on the eastern side of the Southern Branch (lying between the lands of George Newton and Sally Hodges) and negro Charles and he is to receive of the executor fifty six dollars and 55 cents.

The answer of James Hodges in his own right and as administrator of his father Matthias Hodges deceased to the bill of complaint exhibited against him & others in this worshipful Court by Matthias Hodges & others.
This deft. as administrator aforesaid for answer to the said bill saith that he admits the statements and allegations of the said bill to be true--that he has no (??) for holding the said negros as administrator & is willing to surrender them for division in his own right he anwers that he admits the matters & things contained in the said bill to be true & that he is equally with the plas. anzious to have a division of the lands & slaves in the manner prayed for in the bill. Without that etc.

The answer of Jesse & Sally Hodges infants orphans of Matthias Hodges dec'd by James Hodges their guardian to the bill of complaint exhibited against them & others in this Court by Matthias Hodges & others.
These defts. say their said guardian for answer to the said bill say that they admit all the matters & things contained in said bill to be true & that they have no objection that division of lands & slaves as is prayed for in the bill. May be made under a decree of this Court.

To the worshipful Court of Norfolk County sitting in Chancery, Humibly complaining sheweth to your worships your orators and oratrix Matthias, John, William, Christopher, Zachariah, Nathaniel & Abigail Hodges.
That their father Matthias Hodges late of this County departed this life in the present year 1815 seized & possed of a tract of land on the Southern Branch in said county containing by estimation three hundred acres more or less, a house & lot in the town of Portsmouth upon High Street purchased from Veale & negro slaves Daniel, Lucy, Charlotte & Charity. That the said Matthias Hodges was entitled to a proportion of the lands and slaves of Benjamin Hodges, deceased which since his death hath been recovered & which consist of a tract of land also on the Southern Branch containing about sixty acres and negros Jacob, Isaac, Clarissa, Silvia & Bell. The administrator hath purchased out of the funds of the estate two other negros to wit: Jim & Tammy who are now considered the estate of said Matthias Hodges. That the said Matthias Hodges left the following children to wit your orator and oratrix & James, Jesse & Sally Hodges and the descendants of Joseph Hodges another child to wit: Polly, Jehu, Matthias, & Joseph Hodges.
And your orators and oratrix further state to your worships that the said Matthias Hodges, died intestate and that his children aforementioned & their descendants are wholly entitled to the lands & negros herein before enuminated. That being so entitled your orators & oratrix are anxious to have their proportions of said estate allotted & set apart to them. James Hodges is the administrator of the said intestate & has the said slaves in his possesion. Your orators & oratrix are advised that no division of the said lands & slaves can be made which will be obligatory & valid within the consent of the said James Hodges the administrator & because two of the said children the said Jessie & Sally and the said Jehu, Matthias, Polly & Joseph are under the age of twenty one years, unless it is done under a decree of this Court. In tender consideration whereof and for as much as your orators and oratrix is (?) at common law and can only be relieved in this worshipful court where matters of this nature are along coquerzable. To this and that the said James Hodges as administrator aforesaid and in his own right may answer & say if the allegations & statements of this bill are (unreadable) and if he is willing to give up the said slaves in order to a division, that the said Jesse & Sally Hodges & the said Polly, Jehu, Matthias, & Joseph Hodges are of whom are infants may be their guardian or met friends answere all & singular the matter & things herein contemat & say if they are not true and that by a decree of this Court commissioners may be appointed & directed to make division of the said lands & slaves between the parties according to their respective rights & interests therein. May it please your worships to grant the Commonwealth, writ of subpona etc.
