Mrs. Mary J. Mercer, wife of the late Dr. F. M. Mercer, died yesterday at the home of her daughter, Mrs. William Hatton, 45 Dinwiddie Street, in the 78th year of her age. Mrs. Mercer's death was quite sudden, she being out in the street but a short time before she died. She leaves three children, Mr. William Mercer and Mrs. Hatton, of this city and Mr. Joseph Mercer of Baltimore. Arrangements for the funeral will be made later.

Funeral--The funeral of Mrs. Mary J. Mercer took place yesterday morning from St. Paul's Catholic church. The services were conducted by Rev. Father Brady. The remains were interred in Oak Grove cemetery. The following were pallbearers: Joseph A. Parker, William J. Parker, W. C. Nash, John J. Shea, T. J. Dashiells and Joseph A. O'Connor.

On this 28th day of August A. D. one thousand eight hundred and fifty one personally appeared before me, a Justice of the Peace within and for the County and State aforesaid Shadrack W. Outten aged sixty two years, a resident of Elizabeth City county in the State of Virginia, who being duly sworn according to law, declares, that he is the identical Shadrack W. Outten who was a corporal or private in the Company commanded by Captain Isaac Smith in the Regiment of Viriginia Militia commanded by whom I do not recollect. Captain Smith was of Accomack County and Captain of Militia in an Accomack Regiment, number not recollected, that he was called into service in Accomack County at Pasuqotaoque day not recollected A. D. year not recollected--that he was enrolled into service and kept guard at many times and on many occasions cannot say how long he served althgether, but thinks he may have served at least six months and was discharged near about the end of the war--muster roll s of his company will know the time of his service.
He makes this declaration for the purposes of obtaining the bounty land to which he may be entitled under the "Act granting bounty land to certain officers and soldiers who have been engaged in the military service of the United States," passed September 28th, 1850.

If I am mistaken in this and did received such discharge, it has been lost, but I have not the slighest recollection of ever having received a written discharge. On this 28 day of July, A.D. one thousand eight hundred and fifty five, personally appeared before me, a Justice of the Peace, within and for the county and state aforesaid, Shadrack W. Outten, aged 66 years, a resident of Hampton, in the State of Virginia, who being duly sworn according to law, declares that he is the identical man, who was a corporal in the company commanded by Captain Isaac Smith in the regiment of ____ commanded by Col. Bailey in the war with Great Britain declared by the United States 18 June 1812 for the term of ___, and continued in actual service in said war for fourteen days; that he has heretofore made application for bounty land under the act of September 1850 and received a land warrant no. ___, for 40 acres, which he has since legally disposed of and cannot now return.
He makes this declaration for the purpose of obtaining the additional bounty land to which he may be entitled under the act approved the 3rd day of March, 1855. He also declares that he has never applied for nor received, under this or any other act of Congress, any bounty land warrant , except the one above mentioned.

On this twenty-seventh day of April A. D. one thousand eight hundred and seventy eight, personally appeared before me, S. E. Beckford, Clerk of th County Court of Elizabeth City Co., the same being a court of record within and for the County and State aforesaid, Nancy Outten , aged 76 years, a resident of Elizabeth City Co., in the State of Virginia, who being duly sword according to law, declares that she is the widow of Shadrack W. Outten deceased, who was the identical Shadrack W. Outten who served under the name of Shadrack W. Outten as a private in the Company commanded by Captain Perry Moore in the regiment of volunteers commanded by (don't know) (forgotten) in the War of 1812; that her said husband volunteered at Accomac County on or about the ___day of ___A. D. 1812 for the term of __-, and continued in actual service in said war for the term of the war and whose service terminated, by reason of the end of the war at Accomack, on the ___, day of __A.D. ___ She further states that the following is a full description of her said husband at the time of his enlistment: viz: aged 22, farmer, Accomack Co., Virginia was his birthplace, very near six feet high, was light complexted, eyes & hair light. She further states that she was married to the said Shadrack W. Outten near the town of Hampton, in the county of Elizabeth City and in the State of Virginia on the 3rd day of Dec. A. D. 1864. by one M. L. Chevers, who was a chaplain in army; and that her name before her said marriage was Nancy Field and that she has not remarried since the death of said Shadrack W. Outten ; and she further states that she has been married before to R. Rolland, who died 20 years before she married again. Said S. W. Outten had two wives before his marriage to present applicant, both of whom died before his marriage to her; and that her said husband Shadrack W. Outten, died at Mill Creek in the county of Eliz. City, State of Virginia on the 14 day of November A. D. 1871' and she further declares that the following have beem the places of residences of herself and her said husband since the date of his discharge from the Army, viz: Accomac County and Elizabeth City County, Virginia. She makes this declaration for the purpose of obtaining the pension to which she may be entitled under Sections 4736 to 4740, inclusive, Revised Statutes, and the Acto fo March 9, 1878, and hereby appoints, with full powers of substipution and revocations? Samuel V. Niles of Washington, D.C. , her true and lawful attorney to prosecute her claim.
And she further declares that she has not hereto fore made her applicaiton for any bounty or land warrant or pension to any in his life time and that her residence is near Hampton county of Eliabeth City State of Virginia na dthat her post office address is Hampton, Virginia.

Outten, age 40 years: residing at Elizabth co. persons to whom I certify to be respectable and entitled to credit, and who being by my duly sworn, that they have known the said Nancy Outten for 20 years and for 10 years , respectively, that they present and saw her sign her name to the foregoing declaration, that they have every reason to believe, from the appearance of said claimant and their acquaintance with her; that she is the identical person she represents herself to be ;and they further say that they are able to identify her as the person who was the wife of the identical Shadrack W. Outten, who rendered the service all eged in the above applicaiton (in the company of Captain's Perry Moore, in the regiment of in the war of 1812 by the following named facts and circumstances, viz: We know that she is the widow of Shadrack W. Outten because we was present at their marriage and the other knows that they were man & wife and lived together as one. We have often been S. W. Outten state events of the war in which he and they know that she has nor remarried since the death of Shadrack W. Outten her husband, and that they have no interest in the prosecution of this claim.

I am fifty-four years of age. I am a native of Elizabeth City County, where I have resided all my life. I was present at the marraige of Mrs. Nancy Outten to Mrs. Shadrack W. Outten. She was the widow Roland when Mr. Outten married her. They were married on the 3rd may of December 1864, at my house in said county, by Rev. M. L. Chevers. Parson Chevers was a chaplin in the army being at Fort Monroe; there were no ministers or magistrates in the county at that time and the clerk's office was closed. It was during the war. There was a Mr. Miller there and my daughters Alice and Mary and myself. Alice was about 12 years of age at the time. The Rev. Mr. Chevers is dead. Mrs. Outten was an inmate of my family when she was married. They remained at my house that night and Mrs. Outten took her to his house on the next day, where thely lived together until his death. There is no public record of their marriage unless the parson kept one. The churches, the courts and the clerk's office was closed at the time.
I do not know where Mr. Miller is. He did not belong here, and I suppose he has gone to his home

I was a child but remember it very well, I do not remember the exact time, but know it was during the war.

My name is Selnya E. Bickford , I am Clerk of the County and Circuit Courts of Elizabeth City County, State of Virginia. I was in the said county during the year 1864. There was no clerk's office, or clerk, or public record kept in said county during that year. There is no regestry or record of any marriages or of any license for marriages in the record, of said coounty for the year 1864.
The said county was then under military law and the civil law was suspended.

I, G. M. Peek a commissioner in chancery for the circuit court of Elizabeth City County, State of Virginid do certify, that James T. Outten, personally known to me, personally appeared before me in my county aforesaid, on the 18th day of February 1880, and being duly sworn by me deposeth and said as follows:
I am forty two years of age, and am the son of Shadrack W. Outte by a former wife. I am not in any manner interested in the application of Mrs. Nancy Outten the widow of my father for a pension. I left the county of Elizabeth City in 1861 and did not return until 1865, when I returned my father, the said S. W. Outten and my step-mother, Mrs. Nancy Outten were living in the old homestead as man and wife, and they lived together as such until my father's death. After his death commissioners of the court assigned to her her dower as the widow of my father in the real estate to which I inherited as his heir. The papers I now file with their affidavit (marked A. & B.) were found among my fathers papers. My father died on the 17th day of November 1870. I recognized the signature, S. W. Outten, on said papers, as my father's signature. He some times signed his name in full, but I have been unable to find a paper on which he has so signed his name.
Before the late war Mr. Joseph Segan as my father's attorney, received a land warrant for my father under the law granting land warrants to soldiers of the War of 1812..

I was well acquainted with Mr. S. W. Outten of this county and also am acquainted with his widow Mrs. Nancy Outten who is an applicant for a pension. Mrs. Outten has never married since the death of her husband. I was the undertaker who buried Mr. Shadrack W. Outten . He died sometime in the month of November 1870. He was a very old man when he died. I am 56 years of age and live within two miles of Mrs. Nancy Outten.

I am 70 years of age. I was a small boy when Shadrack W. Outten came to this county from the Eastern Shore of Virginia. He was then a man, married and carrying on a farm for himself. He died in November or December 1870. He must have been between 75 and 80 years of age when he died. I know his widow, Nancy Outten, I live within two miles of her house. She has never married since the death of her husband.

Celebration at Portsmouth--The Portsmouth Rifle Company, commanded by Captain William P. Young, met at their usual parade ground, about half past 9 o'clock in the morning of the 4th inst. to comemmorate the Anniversary of their Country's freedom. After performing some handsom evolutions, with that promptness and precision which distinguish the well trained soldier, they marched to the Point near the Ferry Wharf and fired a National Salute, in their accustomed good style. Thence they moved to the Baptist Meeting House, where an appropriate discourse was delivered by the Rev'd Mr. Woodson, after which they repaired to the Cottage, and with a number of their fellow citizens, partook of a sumptuous dinner, prepared for the occasion by Mr. Wm. Outten. Major John Kay presided, assisted by Lieut. Edwards. A number of patriotic sentimental toasts gave additional zest to the entertainment, and at half past 4 o'clock the company retired in very good order, with the pleasing reflection that the occasion was marked by no excess, nor any occurrence calculated to give alloy to this "feast of reason."

Town Meeting
A large and respectable meeting of the citizens of Portsmouth, was held at the Town Hall on Monday evening, Oct. 19th, agreeable to public notice. At the proper time, A. F. Cunningham called the meeting to order; and on his motion, James Murdaugh, Esq. was called to the Chair, and I.C. Schoolfield was appointed Secretary.
The Chairman stated the object of the meeting in a brief address, in which he touchinly adverted to the present embarrassed condition of Portsmouth, and urged the importance of vigorous and united action, in order that our accustomed presperity might be attained.
A. F. Cunningham also addressed the meeting in a forcible and animated manner; previous to resuming his seat, on his motion, a Committee of twenty-five was appointed to deliberate on matters pertaining to the interests of the Town, and to report such action as they deem expedient and desirable at a subsequent meeting. The following gentlemen were appointed as the Committee:

1st Item: I devise to my wife Margaret W. Outten during her natural life all that portion of the lot of land where I now reside in the City of Portsmouth commencing at the south west corner of Dinwiddie and Crab Streets and running along Dinwiddie Street south sixty feet, thence west parallel with Crab Street ninety five feet, thence north sixty feet to Crabb Street, thence east along Crabb Street ninety five feet to the beginning, and at the death of my said wife, I devise the same to my daughter Maragaret A. W. Outten, and the residue of the said lot I devise to my said daughter Margaret A. W. Outten to her and her heirs forever-
2nd Item: I have given a house and lot in the City of Portsmouth to my son in law Doct. Thomas N. Mercer, which I regard as a due proportion of my real estate to his wife (who is my daughter) which is not to be bought into Hotchpot, if the law should have required without this clause, and I give to my daughter Mary Jane Mercer (wife of the said Doct Thomas N. Mercer) one thousand and five hundred dollars to build a house on the corner of King and Dinwiddie Street if she shall devire to do so which I advise should be done and if she does not choose so to appropriate the said sum of fifteen hundred dollars, yet nevertheless she is to have the said sum of fifteen hundred dollars.
3rd Item: I give and bequeath unto my wife Margaret W. Outten a pair of horses and a carriage, which she may choose from them owned by me; also all my household and kitchen furniture to her, her executors and administrators formerly.
4th Item: I give and bequeath to my said wife Margaret W. Outten for and during the term of her natural life, negroes Mary Eliza, Davy, Max, Solomon, Margaret, Sarah, Old George, Charlotte and her three children; also my shares in the Portsmouth Insurance Company somewhere about ninety eight shares; and also fifteen hundred dollars of Virginia State stock and at the death of my said wife I give negro Davy to my daughter Margaret A. W. Outten and the rest of the said negroes given to my said wife by this clause of my will at her death are to be equally divided between my two daugthers, Mary Jane Mercer and Margaret A. W. Outten only intending to give to my said wife the annual interest and dividends of the said stocks.
5th Item: I give and bequeath to my daughter Mary Jane Mercer negroes Dolly, Mariah, Rachael Emma and her child Isaac (the husband of Dolly), Cyrus and John, also forty share of stock in the Merchants & Mechanics Savings Bank of Portsmouth, to her her executors and administrators forever.
6th Item: I give and bequeath to my daughter Margaret A. W. Outten the following negroes Lambert, Ellie, Bob, Courtney, Hannah, Old Mary & her daughter Mary, and young Mary's child; also forty one shares of the stock of the Portsmouth Savings Fund Society in Portsmouth to her, her executors and administrators forever.
7th Iten: I require and direct my executrix & executor hereinafter to be appointed, to take care of and support my old negroes Charity and Old Mary, out of my estate, or out of the money that I may leave and bonds due me.
8th Item: I desire and request my executrix and executor hereinafter to be appointed to have the burying ground for the family inclosed with a good iron railing and marble slab put over the graves of my children and mother who are their buried and also of my brother.
9th Item: I request and desire that there shall be no appraisement of my estate.
10th Item: The rest and residue of my estate of every character and description, I give to my wife Margaret W. Outten and my two daughters Mary Jane Mercer and Margaret A.W. Outten to be equally divided among them.
11th & Lastly: I hereby nominate constitute and appoint my wife Margaret W. Outten executrix and my son in law Doctor Thomas N. Mercer executor of this my last will and testament; hereby revoking all other or former wills and testaments by me heretofore made.

And at the same Court continued by adjoinment and held on the 3rd day of August 1859, on the motion of Margaret W. Outten the executrix and Thomas N. Mercer the executor therein named who made oath thereto, the said Margaret W. Outten together with James G. Hodges her security entered into and acknowledged a bond in the penalty of thirty thousand dollars with condition according to law and the said Thomas N. Mercer togethr with Bernard O'Neill his security entered into and acknowledged a bond in the penalty of thirty thousand dollars with condition according to law, which bonds are ordered to be recorded. Odd Fellow's Funeral--The Odd Fellows yesterday paid the last tribute of respect to their deceased brother, Mr. William Outten. The funeral sermon was preached at the family residence on Dinwiddie street, by Rev. Chas. H. Hall, after which the corpse was borne to the new cemetery, where the solemn services of the Order of which he was a member were performed. The procession was full and may be regarded as representing the high estimate in which the deceased was held here.--Portsmouth Transcript26. Funeral Solemonities--The transcript says, the funeral of Mr. William Outten, which took place last Sunday, was arranged according to the request of the deceased. The family servants, thirty or forty in number, occupied positions in the procession next to the hearse, and we are told by a friend who attended the rites and the graveyard, that he never witnessed more sincere grief than was evinced by them at the loss of their master. Bob Butt, the "Old Sexton", who has been "gathering them in" for long years agone, conducted the arrangement.

To Court of Hustings for City of Portsmouth:
Your Commissioner reports to the Court that on the date hereof T. N. Mercer and Margaret W. Outten executor & executrix of Wm. Outten decd; exhibited before your Commissioner a statement of all the money which they had received or become chargeable with or had disbursed. That the Commissioner embraced said executor and executrix in the list of fiduciaries whose accounts were before him for settlement, which was posted at the front door of the Court House of said City in pursuance of law, and on the date hereof made up and completed the foregoing account and finds of balance of $1169.26, which has been distributed to parties entitled according to Distributer account annexed. The account is supported by satisfactory vouchers and is herewith returned. That the said executor and executrix have given such bond as the law requires and is in a penalty and with securities sufficient.

Also membranous angina. An acute infectious disease characterized by inflammation and the formation of a thick covering on the mucous membranes of the throat and nose. General symptoms included fever, weakness of the heart, and rapidly developing anemia, later understood to be caused by poisons given off from the bacteria responsible for the initiation of the disease. Severe epidemics were reported in different parts of Europe during the 16th, 17th, and 18th centuries. It was a disease of childhood and very fatal. Know all men by these presents, that we William Outten and Jas. G. Tanner are held and firmly bound unto Jno. Floyd Esquire, Governor of this Commonwealth, in the just and full sum of One hundred and fifty dollars; to the payment whereof, well and truly to be made to the said Governor and his successors in office, we bind ourselves, our heirs, executors and administrators, firmly by these presents. Sealed with our seals, and dated this 30th day of May 1833.
The condition of the above obligation is such, that whereas a marriage is shortly intended to be had and solemnized between the above bound William Outten and Miss Margaret Manning. Now, if there be no lawful cause to obstruct the said marriage, then the above obligation to be void, otherwise to remain in full force and virture.

The obsquires of the highly esteemed citizen, Mr. William H. Outten, took place from the residence of his son-in-law, Mr. John B. Robertson, South street extened, Sunday afternoon at 4 o'clock. Ther services were conducted by the Rev. Geo. E. Bunker, of Wright Memorial Church, and the Interment took place in Oak Grove Cemetery. Portsmouth Lodge No. 16, K. of P., of which the deceased was an honored member, attended the funeral in a body.2. Obituary 3200, 21 Apr 1900 in Norfolk Co., Virginia
Following were the pall bearers: William Jobson, John I. Nelson, A. C. Bushnell, John T. King, John C. Hoy, W. t. anderton, Knights Pythias--John Wilson and Thomas Gwin.
Outten--At the residence of his son-in-law, Mr. John H. Robertson, South Street Road, Norfolk County, Virginia, April 20, 1900, 7:25 a.m., William H. Outten, aged 59 years, 4 months.
